GRN to develop Sub-Saharan Africa’s largest green hydrogen project with Hyphen Hydrogen Energy

Slaughter and May advised Hyphen Hydrogen Energy on the pioneering US£10 billion feasibility and implementation agreement which it agreed with the Government of the Republic of Namibia(GRN) for the development of Sub-Saharan Africa’s largest green hydrogen project.

The bespoke feasibility and implementation agreement was crafted by Hyphen and Slaughter and May in conjunction with the Government of the Republic of Namibia’s Green Hydrogen Council and its international advisers. The one-of-a-kind agreement will govern the development, implementation and operation of Namibia’s first GW-scale green hydrogen project, anticipated to require capital investments of US$10 billion.

The agreement also had to cater to the fully vertically integrated nature of the project (from upstream power production to downstream green ammonia production and offtake facilities), which is unique and unprecedented in Africa.

Slaughter and May acted as lead international counsel to Hyphen Hydrogen Energy on the transaction and will continue to advise Hyphen Hydrogen Energy on all aspects of the development of the project, with ENSafrica providing support on Namibian law aspects of the deal.
